The Role of Consensus Standards In Today's SH&E Community

Session Description:

National consensus standards play a pivotal role in development of world-class safety programs, but they also have legal consequences in terms of duties of care in tort cases as well as establishment of norms under OSHA's General Duty Clause. Increasingly, they are also being used to create new binding standards, under the Technology Transfer Act's mandates. Learn how to identify and incorporate applicable standards into your safety, health and environmental programs, understand the obligations such standards may create, and hear about recent litigation involving consensus standards.

Abrams, Esq., CMSP, REA is an attorney and Certified Mine Safety Professional, who is admitted to the MD, DC and PA Bars, US District Courts (MD and DC); US Ct. of Appeals, DC Cir., and US Supreme Court. She earned her JD, at George Washington University National Law Center. )Her legal practice includes employment, occupational safety/mine safety and health litigation, and HR/safety compliance training. Adele also is on the adjunct faculty of Catholic University of America, teaching employment law for the Metropolitan College's Masters in Management program. She is co-chair of the National Institute for Occupational Safety and Health's NORA Mining Sector Council. Adele is president of the Law Office of Adele L. Abrams, PC, in Beltsville, MD and is a professional member of ASSE's Mining and Construction practice specialties.
